      In this course, you will discover the importance of choosing the right certification for your small business.  Every business will be different upon their own specific goals and services provided, therefore use this course as a guideline to help you choose the perfect name for your business and your brand that best serves your goals.

  • Types of Small Business Certifications in New Jersey

    This section will explore the different types of small business certifications offered by the state of New Jersey.

    • A minority and/or woman-owned business or enterprise (M/WBE) can get certified with the State of New Jersey. While the New Jersey state government does not give special consideration to vendors that hold M/WBE certifications, some local government contracts do give special consideration.

      Eligibility

      A woman or a minority-owned business can apply.

      A Minority means a person who is: 1) Asian American, a person having origins in any of the original peoples of the Far East, Southeast Asia, Indian Subcontinent, Hawaii, or the Pacific Islands; 2) American Indian or Alaskan native, a person having origins in any of the original peoples of North America. 3) Black, a person having origins in any of the black racial groups in Africa; or 4) Hispanic, a person of Spanish or Portuguese culture, with origins in Mexico, South or Central America, or the Caribbean Islands.

      A "Woman" or "women" means an individual, regardless of race, who self-identifies her gender as a woman, without regard to the individual's designated sex at birth.

      Qualifying Businesses and Enterprises

      1. A sole proprietorship, owned and controlled by a minority or woman;

      2. A partnership or joint venture, owned and controlled by minorities and/or women in which at least 51% of the ownership interest is held by minorities and/or women and the management and daily business operations of which are controlled by one or more of the minorities and/or women who own it; or

      3. A corporation or other entity, whose management and daily business operations are controlled by one or more minorities and/or women who own it, and which is at least 51% owned by one or more minorities and/or women, or, if stock is issued, at least 51% of the stock is owned by one or more minorities and/or women.

    • VOB or veteran-owned business is a business that has its principal place of business in the State, is independently owned and operated, and at least 51% of the business is owned and controlled by persons who are veterans. DVOB is a disabled veteran-owned business. These certifications require different applications and offer different opportunities.

      VOB Eligibility and Registration

      A "Veteran" is any citizen and resident of this State now or hereafter honorably discharged or released under honorable circumstances who served in any branch of the Armed Forces of the United States or a Reserve component thereof for at least 90 days and shall include disabled veterans.

      A "Veteran-owned business" is a business that has its principal place of business in the State, is independently owned and operated, and at least 51% of the business is owned and controlled by persons who are veterans. The Principal Owner must provide a copy of their Federal Form DD-214 indicating honorable discharge or release under honorable circumstances.

      If you are a VOB and seek certification, register online with the State of New Jersey application. This certification needs to be reverified annually, complete the VOB verification form here.

      DVOB Eligibility and Registration

      Disabled Veterans-owned business means a business that:

      1. Has its principal place of business in the State, is independently owned and operated, and at least 51% of the business is owned and controlled by persons who are disabled veterans; or    
      2. Is a business that has its principal place of business in this State and has been officially verified by the United States Department of Veterans Affairs as a service-disabled veteran-owned business for the purposes of department contracts under Federal law.

      To register as a New Jersey Disabled Veteran Owned Business (DVOB), complete and submit the New Jersey Disabled Veteran Owned Business Registration Application. DVOB certification needs to be reverified annually, you can reverify your DVOB status through the New Jersey Portal.

      Application Requirements

      In all cases, provide a copy of your proof of business registration with the State of New Jersey.

      If you wish to be registered under definition one above, include with your application a Service Connected Award Letter, or comparable communication, from the federal Department of Veterans Affairs for each owner that is a disabled veteran.

      If you wish to be registered under definition two above, include with your application the firm's Federal Service Disabled Veteran Owned Business Determination Letter.

    • Businesses can become an SBE or Small Business Enterprise through New Jersey's Set-Aside Program. Registered businesses become members of a limited group of vendors eligible to participate in selected contract offerings. The State aims to award 25% of its contracts and purchase order dollars to organizations registered as small businesses.

      Eligibility

      For goods and services contracts, small businesses with no more than 100 full-time employees must be registered in one of the following three categories:

      • Small businesses whose gross revenues do not exceed $500,000
      • Small businesses whose gross revenues do not exceed $5 million
      • Small businesses whose gross revenues do not exceed $12 million or the applicable federal revenue standards established at 13 CFR 121.201, incorporated herein by reference, whichever is higher, as may be adjusted periodically.

      For state construction contracts, small businesses with no more than 100 full-time employees will be registered in one of the following three categories:

      • Small business with gross revenues that do not exceed $3 million.
      • Small businesses with gross revenues that do not exceed 50 percent of the applicable annual revenue standards outlined in federal regulation at 13 CFR 121.201, incorporated herein by reference, and as may be adjusted periodically.
      • Small business with gross revenues that do not exceed the applicable annual revenue standards outlined in federal regulation at 13 CFR 121.201, incorporated herein by reference, as may be adjusted periodically.

      The business must be independently owned and operated, with management being responsible for both its daily and long-term operation, as well as owning at least 51 percent interest in the business.

      Businesses must be incorporated or registered with the Division of Revenue & Enterprise Services to do business in the State and have their principal place of business in New Jersey, defined when:

      • 51 percent or more of its employees work in New Jersey supported by paid New Jersey unemployment taxes or;
      • 51 percent or more of its business operations/activities occur in New Jersey supported by income and/or business tax returns.
      • The business must be a sole proprietorship, partnership, limited liability company, or corporation with 100 or fewer employees in full-time positions, not including:
      • Seasonal and part-time employees employed for less than 90 days, if seasonal and casual part-time employment are common to that industry and
      • Consultants employed under contracts for which the business wants to be eligible as a small business.

      Registration

      To apply for small business registration and participation in the New Jersey Small Business Set-Aside Program, you may submit the New SBE Online Registry Service Application.


      Government Contacts

      The State of New Jersey Small Business Set-Aside Program was established to award 25 percent of state contracting and purchase order dollars to small businesses. By registering your small business with the New Jersey Small Business Set-Aside Program, through the Division of Revenue & Enterprise Services, your company becomes a member of a limited group of vendors eligible to participate in these selected contract offerings.

      The ESBE program is a race- and gender-neutral program designed to provide select contracting opportunities to small, economically disadvantaged businesses. The program runs concurrently with the Disadvantaged Business Enterprise (DBE) program on federally funded projects.

      The program uses the same eligibility criteria as its DBE program, with one exception: The owner is not required to be a socially disadvantaged group member. If your firm is certified as a DBE, ESBE certification is automatic. NJDOT provides a directory of certified ESBEs, including DBEs that qualify as ESBEs. ESBE certification must be renewed each year.

    • A lesbian, gay, bisexual, transgender, queer, questioning business (LGBTQ+) is a business that is at least 51% owned, operated, and controlled by persons who identify as LGBTQ+. Once a business has obtained certification, its contact information will be posted to a public database called Selective Assistance Vendor Information (SAVI), allowing state agencies or prime contractors to the state to identify all certificate-holding businesses.

      Qualifying Businesses and Enterprises

      1. At least 51% owned, operated, and controlled by persons who identify as LGBTQ+ (lesbian, gay, bisexual, transgender, queer, questioning)
      2. Independently owned, operated, and controlled business that is generating revenue in New Jersey
      3. Owner must be competent in the affairs in the business to show operational and managerial control
